GUEST WAIVER AND TERMS & CONDITIONS
Please read this document carefully before signing or making payment. By paying your deposit and/or signing (including electronically), you confirm that you have read, understood, and agree to the following terms.
INTRODUCTION AND DEFINITIONS
Contracting Party:
All bookings and payments are made under a contract between Dreamy Retreats Ltd (“we”, “our”, or “us”) and the individual named in the booking (“you”, “your”, or the “Guest”).
Acceptance of Terms:
By paying a deposit or any part of the retreat fee, you acknowledge and agree that you are entering into a binding contract with Dreamy Retreats Ltd and are subject to these Terms & Conditions and Waiver in full.
Definitions:
“Guest” refers to the individual participating in and attending the retreat, including anyone booked on their behalf.
“Retreat” refers to the yoga retreat experience organised by Dreamy Retreats Ltd, with the dates and location specified in the booking, including but not limited to accommodation, meals, yoga sessions, workshops, excursions, and other activities.
1. BOOKINGS AND PAYMENTS
1.1. All bookings are confirmed only upon receipt of full payment (or deposit, if applicable).
1.2. All payments made to Dreamy Retreats Ltd are non-refundable under any circumstances, including but not limited to personal illness, travel disruption, or changes in personal circumstances.
1.3. Bookings are non-transferable unless expressly agreed in writing by Dreamy Retreats Ltd.
1.4. Guests must make all scheduled payments on or before the due dates communicated by Dreamy Retreats Ltd.
1.5. If a guest fails to make a payment by the specified due date, Dreamy Retreats Ltd reserves the right to cancel the booking without providing any refund or credit for amounts already paid.
1.6. Dreamy Retreats Ltd is not responsible for any costs or losses incurred by the guest due to such cancellation.
2. TRAVEL INSURANCE
2.1. All guests are required to obtain comprehensive travel and medical insurance that covers trip cancellation, injury, illness, personal liability, and loss of belongings.
2.2. Proof of insurance may be requested prior to or upon arrival at the retreat.
3. HEALTH AND FITNESS
3.1. Guests participate in all yoga sessions, activities, excursions, and meals at their own risk.
3.2. It is the responsibility of each guest to ensure that they are physically and mentally fit to participate in the retreat.
3.3. By signing this waiver, you confirm that you have disclosed any relevant health conditions and that you are in a sufficient mental and emotional state to take part in a group environment without posing a disturbance or risk to yourself or others.
3.4. Dreamy Retreats Ltd reserves the right to ask any guest to leave the retreat, without refund, if their behaviour is deemed inappropriate, disruptive, or unsafe to themselves or others.
4. LIABILITY WAIVER
4.1. Dreamy Retreats Ltd, its directors, employees, teachers, contractors, and affiliates accept no responsibility or liability for:
any injury, illness, accident, loss, or damage to person or property,
any death or injury arising directly or indirectly from participation in retreat activities, yoga sessions, excursions, transportation, or meals provided,
any loss or theft of personal belongings during the retreat.
4.2. Guests understand that participation in yoga and related activities involves physical movement, and acknowledge the inherent risks involved. Guests voluntarily assume all such risks.
4.3. Dreamy Retreats Ltd shall not be liable for any delay, cancellation, or change to the retreat schedule due to unforeseen circumstances, including but not limited to weather, natural disasters, pandemics, or travel disruptions.
5. RETREAT LEADER, VENUE, AND PROGRAMME CHANGES
5.1. The retreat is intended to be led by Sanya Ormiston.
5.2. In the event that Sanya Ormiston is unable to attend or lead the retreat due to illness, emergency, travel disruption, or any other reason beyond reasonable control, Dreamy Retreats Ltd reserves the right to appoint a qualified substitute host and/or yoga teacher.
5.3. Dreamy Retreats Ltd also reserves the right to change the retreat venue if necessary due to unforeseen circumstances, including but not limited to safety concerns, venue unavailability, or force majeure events.
5.4. The appointment of a substitute host or teacher, or any change to the retreat venue, shall not constitute grounds for cancellation, refund, or compensation.
5.5. Dreamy Retreats Ltd will make reasonable efforts to ensure the quality and integrity of the retreat experience remain consistent with the original intention.
6. FOOD AND ALLERGIES
6.1. While Dreamy Retreats Ltd will make reasonable efforts to accommodate dietary preferences or allergies, it cannot guarantee that all meals will be allergen-free.
6.2. Guests are responsible for managing their own dietary requirements and for carrying any necessary medications (e.g., EpiPens).
7. PERSONAL CONDUCT
7.1. Guests agree to behave respectfully towards all staff, teachers, and other guests.
7.2. Drug use or excessive alcohol consumption is not permitted.
7.3. Dreamy Retreats Ltd reserves the right to terminate participation without refund for any guest engaging in disruptive, aggressive, or inappropriate behaviour.
8. MEDIA RELEASE
8.1. From time to time, photography or video may be taken during the retreat.
8.2. By signing this document, you grant Dreamy Retreats Ltd permission to use such media for promotional purposes, unless you notify us in writing prior to the retreat that you do not consent.
9. ELECTRONIC SIGNATURES
9.1. This agreement may be signed electronically, and such signature shall have the same legal force and effect as a handwritten signature.
9.2. By electronically signing or clicking “I agree” (or equivalent), you acknowledge that you have read, understood, and voluntarily accepted these Terms & Conditions and Waiver.
9.3. You agree that electronic records of your consent and signature will be admissible in any legal proceeding and deemed authentic evidence of your acceptance.
10. GOVERNING LAW
This agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
I have read and understood the above Terms & Conditions and Waiver, and I voluntarily agree to be bound by them.
